1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of Auvoxi, including our website, dashboard, IELTS practice tools, AI-powered learning features, subscription features, reports, notes, retake records, and related services (collectively, the “Services”).

Auvoxi is operated by an individual operator based in China. By accessing or using the Services, creating an account, starting a subscription, submitting content, or using any paid or credit-based feature, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Services.

2. Independent Platform and Non-Affiliation

Auvoxi is an independent IELTS practice platform. Auvoxi is not affiliated with, endorsed by, approved by, or connected to IELTS, Cambridge University Press & Assessment, the British Council, IDP Education, or any official IELTS test owner, exam center, or administrator.

“IELTS” is a trademark owned by its respective owners. Any reference to IELTS is used only to describe the type of exam preparation and practice experience offered by the Services.

All practice materials on Auvoxi are independently created for educational and practice purposes. Auvoxi does not provide official IELTS tests, official IELTS materials, official IELTS scores, official exam booking, or official certification.

3. Eligibility and Accounts

You must be at least 13 years old to use the Services. If you are under the age required by your local law to use online services, you may use the Services only with permission and supervision from a parent or legal guardian.

To purchase a subscription or paid access, you must be legally able to make the purchase, or the payment must be authorized by a parent, guardian, or other authorized payer.

You are responsible for maintaining the confidentiality of your account, login method, and device sessions. You are responsible for all activity under your account, whether or not you authorized it, unless the activity was caused by our own security failure.

You agree to provide accurate account, payment, and contact information and to keep it reasonably up to date.

4. Services and Educational Use

Auvoxi provides IELTS practice and learning tools, including Listening practice, Reading practice, Writing practice, Speaking Simulator, AI-generated reports, Ask AI Tutor, saved notes, starred tests, retake records, and related dashboard features.

The Services are designed for educational practice only. We do not guarantee any official IELTS score, exam result, visa result, admission result, employment result, or other outcome.

You are responsible for how you use the Services, learning materials, AI outputs, reports, explanations, and feedback.

The Services are designed primarily for use on desktop or laptop computers. Mobile browsers, small screens, tablets, or unsupported devices may not provide full functionality, stable layout, or complete access to all practice features.

5. Subscriptions, Plans, Credits, and Storage Limits

5.1 Plans and Access

Auvoxi may offer Free and paid subscription plans. Available features, monthly credits, report storage limits, retake record storage limits, prices, taxes, billing intervals, and other usage limits vary by plan and may be displayed on the Pricing, Subscription, checkout, or account management page.

Listening and Reading practice access may be offered free of credit charges, while AI-powered features such as Writing reports, Speaking Simulator, Speaking reports, and Ask AI Tutor may use credits.

5.2 Credits

Credits are usage units for eligible AI-powered features. Credits are not cash, stored value, currency, property, or a bank balance. Credits cannot be sold, transferred, exchanged for cash, withdrawn, or used outside Auvoxi.

Your account may receive monthly credits depending on your plan. Unused credits may remain available in your account while your account remains active, but credits are always subject to plan rules, abuse controls, technical limits, cancellation status, downgrade status, and these Terms.

We may correct, remove, or adjust credits that were added because of system error, payment reversal, chargeback, fraud, abuse, unauthorized access, or attempts to bypass billing or usage limits.

5.3 Report and Retake Storage

Writing report storage, Speaking report storage, and Speaking retake record storage are limited by plan. If your account exceeds the applicable storage limit, older items may be removed or become unavailable according to the product rules for that feature.

You are responsible for downloading or saving any content you want to keep before deleting it, downgrading your plan, canceling your subscription, or deleting your account.

5.4 Changes to Plans and Features

We may add, modify, limit, rename, or remove features, plans, credits, storage limits, or usage rules from time to time. If we make a material change that affects paid access, we will try to provide reasonable notice where practical.

6. Payments, Renewal, Cancellation, and Failed Payments

6.1 Payment Processing

Payments, subscriptions, taxes, invoices, and certain buyer support functions may be handled by Paddle, which may act as the merchant of record and authorized reseller for eligible Auvoxi digital products. When you purchase through Paddle, your payment and billing relationship for that transaction may be with Paddle, and Paddle’s checkout terms, buyer terms, privacy notice, and payment support process may also apply.

By purchasing a subscription or paid access, you authorize Paddle or the applicable payment infrastructure to charge the selected payment method according to the plan, price, billing interval, taxes, and terms shown at checkout. We do not store your full payment card number, bank account details, or complete payment credentials.

6.2 Automatic Renewal

Paid subscriptions may renew automatically unless canceled before the renewal date. Paddle or the applicable payment infrastructure may charge your payment method at the beginning of each billing period unless you cancel in time. Renewal terms, billing intervals, prices, taxes, and cancellation options may be shown at checkout, in your account, or through the applicable billing management process.

6.3 Cancellation

You may cancel your subscription through the available billing or subscription management options. Cancellation stops future renewals but does not automatically refund amounts already paid.

After cancellation, you may generally keep paid access until the end of the current paid billing period, unless your account is suspended or terminated for abuse, fraud, chargeback, security reasons, or violation of these Terms.

6.4 Failed Payments

If a payment fails, is reversed, is disputed, or cannot be verified, we may limit, suspend, downgrade, or remove paid access until the payment issue is resolved.

7. Refunds

Refunds are governed by our Refund Policy. By purchasing a subscription or paid access, you acknowledge and agree to the Refund Policy.

Because Auvoxi provides digital, credit-based, and AI-powered services, used credits, generated reports, used Speaking Simulator sessions, used Ask AI Tutor requests, and other consumed digital services are generally not refundable.

If a refund is approved by us or processed through Paddle’s applicable buyer support or payment process, we may revoke the related paid access, remove related unused credits, cancel the subscription, restrict further use of the refunded service, or close the account where necessary to prevent abuse or double use of paid services.

Chargeback abuse, payment disputes made in bad faith, attempts to receive both service access and refund benefit, or attempts to bypass our billing system may result in account suspension or termination.

Nothing in this Refunds section limits any mandatory refund, cancellation, withdrawal, or consumer protection rights that cannot be excluded under applicable law.

8. Acceptable Use

You agree not to:

  • share, sell, rent, transfer, or resell your account, subscription, credits, reports, or access to others;
  • attempt to bypass credits, plan limits, storage limits, paywalls, subscription checks, rate limits, or security controls;
  • use bots, scripts, scrapers, crawlers, automated tools, or bulk access methods without permission;
  • copy, scrape, extract, redistribute, sell, or republish our practice materials, audio, questions, answers, reports, UI, or databases;
  • reverse engineer, decompile, interfere with, overload, or attempt unauthorized access to the Services;
  • use the Services for illegal, harmful, abusive, harassing, defamatory, fraudulent, or infringing activity;
  • upload malware, harmful code, spam, or content that violates the rights of others;
  • submit sensitive personal data that is not needed for IELTS practice, such as government ID numbers, payment credentials, medical records, or passwords;
  • use the Services to generate content that violates law, infringes rights, or harms others.

We may restrict, suspend, or terminate accounts that violate these Terms or create risk to Auvoxi, users, payment systems, service providers, or third parties.

9. User Content and Learning Inputs

You may submit, create, or save content through the Services, including writing responses, speaking transcripts, notes, answers, messages, feedback requests, and other learning inputs (“User Content”).

You retain ownership of your User Content. You grant Auvoxi a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, analyze, and use User Content as reasonably necessary to provide, maintain, secure, debug, and operate the Services, including generating reports, feedback, explanations, and learning assistance requested by you.

We do not use your Writing submissions, Speaking recordings, transcripts, reports, or Ask AI Tutor conversations to train our own AI models. Our paid AI and speech processing providers are configured so customer prompts, responses, audio, and transcripts are not used for model training or product improvement.

You represent that you have the right to submit your User Content and that your User Content does not violate law, infringe third-party rights, or contain material you are not allowed to provide.

10. AI Features, Reports, and Accuracy

Some Services use AI-powered processing to generate feedback, scoring support, explanations, reports, speaking practice interactions, or learning assistance.

AI outputs may be inaccurate, incomplete, delayed, inconsistent, or unsuitable for your specific situation. Band scores, feedback, corrections, suggestions, and explanations are estimates or educational guidance only.

You should not treat AI outputs as official IELTS scores, official exam advice, legal advice, immigration advice, academic admission advice, medical advice, financial advice, or professional advice.

We may refuse, limit, or remove AI outputs or user inputs if they appear to violate these Terms, create safety risks, involve abuse, or are technically unsupported.

11. Intellectual Property

The Services, website design, code, UI, databases, independently created practice materials, audio, questions, answer keys, explanations, reports, graphics, branding, and related content are owned by Auvoxi or its licensors, except for User Content and third-party materials used under applicable rights.

Without limiting the above, Auvoxi owns or controls all rights in the independently created learning materials made available through the Services, including Listening, Reading, Writing, and Speaking practice content, passages, prompts, questions, answer keys, explanations, audio, images, graphics, report templates, UI content, and related educational materials, except for User Content and third-party materials used under applicable rights or licenses.

You may use the Services for personal educational practice only. You may not copy, modify, distribute, sell, license, publish, scrape, mirror, create competing datasets from, or commercially exploit any part of the Services unless we give written permission.

12. Third-Party Services

The Services may rely on third-party services for hosting, payments, authentication, analytics, security, email, AI processing, and other technical functions. Your use of third-party payment pages, login tools, or external links may also be subject to the terms and privacy policies of those third parties.

We are not responsible for third-party websites, platforms, payment providers, outages, policy changes, or actions outside our reasonable control.

13. Service Availability and Changes

We try to provide reliable access, but the Services may be interrupted, delayed, limited, modified, or unavailable because of maintenance, updates, network issues, provider outages, payment provider issues, security incidents, legal requirements, or events outside our control.

We do not guarantee uninterrupted, error-free, or permanently available access to any feature, test, report, audio, AI feature, subscription feature, or stored content.

14. Suspension and Termination

We may restrict, suspend, downgrade, or terminate your access if we reasonably believe that:

  • you violated these Terms or another Auvoxi policy;
  • your payment failed, was reversed, was disputed, or appears fraudulent;
  • your account is involved in chargeback abuse, credit abuse, scraping, automation, unauthorized sharing, or attempts to bypass limits;
  • your use creates security, legal, technical, payment, or abuse risk;
  • we are required to do so by law, payment provider rules, or a lawful request.

You may stop using the Services at any time. You may request account deletion where available, subject to retention needed for legal, security, payment, fraud prevention, dispute, and enforcement purposes.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUVOXI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

We do not guarantee that the Services will meet your expectations, improve your IELTS score, produce accurate scores, remain uninterrupted, remain error-free, or preserve every item of stored content indefinitely.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUVOXI AND ITS OPERATOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, CONTENT, PROFITS, REVENUE, BUSINESS, GOODWILL, EXAM OPPORTUNITY, VISA OPPORTUNITY, ADMISSION OPPORTUNITY, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO AUVOXI FOR THE SERVICES IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 50 IF YOU DID NOT PAY ANY AMOUNT DURING THAT PERIOD.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Auvoxi and its operator from claims, liabilities, damages, losses, and expenses arising from your User Content, your misuse of the Services, your violation of these Terms, your violation of law, your infringement of third-party rights, or your attempt to bypass payment, credit, storage, or security controls.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your place of residence require otherwise.

Before starting a formal dispute, you agree to contact us at [email protected] and try to resolve the issue informally.

If a dispute cannot be resolved informally, it will be submitted to the competent courts or dispute resolution authority with jurisdiction under applicable law. Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

19. Changes to These Terms

We may update these Terms from time to time. When we update them, we will post the updated version on this page and change the “Effective Date” above.

Continued use of the Services after the updated Terms become effective means you accept the updated Terms, to the extent permitted by applicable law.
